وجه وزير الداخلية، عبد الوافي لفتيت، تعليمات صارمة إلى ولاة وعمال العمالات والأقاليم بضرورة الالتزام التام بالمقتضيات القانونية المتعلقة بإحداث أو تجديد فروع الجمعيات، في خطوة تهدف إلى تعزيز الشفافية واحترام القوانين التنظيمية.
وأشار الوزير، في رسالة له إلى ولاة وعمال العمالات والأقاليم، أن الوزارة توصلت بمعلومات حول قيام جمعيات بإحداث فروع أو تجديد مكاتبها دون إخطار السلطات المحلية، وهو ما يخالف مقتضيات الفصل الخامس من الظهير الشريف رقم 1.50.376 الخاص بتأسيس الجمعيات.
وشدد الوزير على ضرورة التحقق من أن الجمعية الأصل قد صرحت بإنشاء الفروع قبل منح أي تصريح أو وصل قانوني، مع التأكد من أن القانون الأساسي للجمعية يسمح بذلك.
وتهدف هذه الإجراءات إلى تجنب النزاعات القانونية التي قد تنشأ عن إنشاء فروع تابعة دون سند قانوني، ما قد يثير مسؤولية السلطات الإدارية.
ونصت الفقرة السادسة من الفصل الخامس على ضرورة التصريح بكل تغيير يطرأ على إدارة الجمعيات أو إحداث مؤسسات فرعية خلال الشهر الموالي وبنفس الشروط، مع عدم إمكانية الاحتجاج بها أمام الغير إلا بعد التصريح بها.
وفي سياق متصل، رفض بعض عمال الأقاليم المصادقة على ميزانيات جماعات ترابية لعام 2025 تضمنت زيادات في بنود دعم الجمعيات، استجابة لتوجيهات وزير الداخلية بتقليل النفقات غير الضرورية. كما تمت إعادة ميزانيات مجالس جماعية أخرى بسبب حالات تنافٍ تتعلق بدعم جمعيات يديرها أقارب ومعارف أعضاء المجالس.
وتأتي هذه التدابير في إطار سعي وزارة الداخلية إلى تعزيز الشفافية وضمان احترام الإطار القانوني المنظم لعمل الجمعيات وفروعها، بما يضمن حماية المصلحة العامة وتحقيق الانضباط في إدارة الموارد المالية.
