تنظم الكلية متعددة التخصصات بتازة التابعة لجامعة سيدي محمد بن عبد الله، يوم 15 ماي المقبل، يوما دراسيا حول موضوع “تحقيق توازن المصالح في القانون التنظيمي المتعلق بتحديد شروط وكيفيات ممارسة حق الإضراب”.
ويهدف اللقاء، المنظم بمبادرة من مختبر القانون العام والسياسة والتدبير والاقتصاد بالكلية، وفريق البحث في الدراسات الدستورية والإدارية المعاصرة، إلى تحليل مضامين القانون التنظيمي المتعلق بالإضراب، ومدى نجاحه في التوفيق بين حماية المصلحة العامة والمصلحة الخاصة من جهة، وفي إقامة التوازن بين حقوق العمال وبين مصالح المشتغلين من جهة أخرى.
وسيناقش المشاركون في اللقاء، أيضا، مجموعة من المقترحات القانونية البديلة لضمان تنظيم متوازن لهذا الحق، يكفل تحقيق وظائفه القانونية والسياسية ويراعي استقرار العلاقات المهنية، ويحفظ الانسجام بين الالتزامات الدستورية والدولية للدولة المغربية.
ويبحث هذا الحدث العلمي مجموعة من المحاور، من بينها “حماية المصلحة العامة واستمرارية خدمات المرافق العمومية الحيوية”، و”حقوق العمال وضمانات الممارسة المشروعة للإضراب”، و”التقييدات القانونية المفروضة على ممارسة الإضراب”، و”تأثير الإضراب على المقاولات والاستثمار.
